In the United States Bankruptcy Court for the District of Puerto Rico, a Chapter 7 Bankruptcy Trustee filed an adversary proceeding seeking to substantively consolidate a family owned corporation with a related company’s bankruptcy estate. If successful, the suit would seize the corporation, its assets and revenue from the family shareholders. During the pendency of this action, the bankruptcy trustee sought to impound corporate income earned by the corporation that is the target of the consolidation. After a contentious three day hearing in federal court, Gomez LLC persuaded a bankruptcy court judge that the Trustee had not presented sufficient evidence to warrant the relief sought. The trustee’s motion was denied by the bankruptcy judge. See Wilfredo Segarra Miranda v. YSIEM Corp., Case No. 02-10788, Adv. Pro. No. 07-00024 (United States Bankruptcy Court for the District of Puerto Rico).
